Can you drink alcohol on Flagler Beach?

State law prohibits drinking and driving which is strictly enforced in Flagler Beach. Open containers are prohibited except on the sand of the beaches. We ask that you pay attention to the speed limit on the roadways and watch for citizens trying to cross to and from the beach, or walking the back roads.

Alcohol may be consumed on sandy portions of the beaches only. This applies both Soundside and Gulfside. It must not be in a glass container. Any person that fails to comply with these policies will face second-degree misdemeanor charges and if convicted can receive a $500 fine and or 60 days jail time.

Person smoking a cigarette at the beach. Since Florida Governor Ron DeSantis signed a bill over the summer allowing local governments to ban smoking on public beaches, Miami Beach, Ft. Lauderdale, Palm Beach and Monroe County have passed legislation enforcing the ban.

Violators could be fined up to $100 for the first infraction, and $200 to $500 for further violations, according to the governments' ordinances. Repeat violators could face up to 60 days in jail. Unfiltered cigars, however, are not covered by the ban.
